EVERY ONE OF THESE DEATHS OR INJURIES CAN BE PREVENTED.

Our Goal Is To Make The World Safer. Unfortunately, Not Everyone Prioritizes Safety. When They Don’t, We Hold Them Accountable. By Hitting Them Where It Hurts Most, Their Pocketbooks, They Are Forced To Pay Attention To Safety. That’s How We Affect Change.

What is Premises Liability? In basic terms, it's when you are hurt on someone else's property.

1

Falls

Every year 8 million people go to the emergency room because of a fall. We’ve successfully handled cases for clients who have fallen in a grocery store, bank, post office, schools, theaters, concert venues, airports and more. Falls can happen for many different reasons: defects in walking surfaces, lack of handrails on stairs, snow and ice, inadequate lighting, and foreign objects on the floor. All falls can be prevented if simple safety rules are followed. We have found that most businesses have safety rules in place, however they choose not to follow them.

2

Assaults

A violent assault occurs every second in the United States. When the assault occurs at a business it is absolutely preventable. No one should be physically or emotionally injured while patronizing a business. Assaults can occur anywhere such as a mall, hotel, restaurant, parking garage, parking lot, apartment complex, night club, and more. Assaults come in many forms. An assault can be due to inadequate security, a robbery, a sexual assault, a rape, an attack, and gun violence. In fact, an assault doesn’t require any physical touching: Simply being placed in fear of bodily harm can be an assault.

Dog Attacks

There are 90 million dogs in the United States. There are approximately 4.7 million dog bites every year in the U.S. Did you know in Massachusetts the owner of a dog is automatically responsible if their dog harms someone? This is called strict liability. It is important to identify the dog’s owner after an injury in order to pursue a dog injury case. Dog injury cases can arise from being knocked down by a dog, severely scratched by a dog, or from a dog bite. Homeowner’s or renter’s insurance usually covers an injury from a dog bite.

Frequently Asked Questions

1. What is a premises case?

In general, it's when you are hurt on someone else's property ( a.k.a. premises), such as a retail store, grocery store, hotel, casino, schools, an entertainment complex, an airport, hospital, parking lot or someone's house.

2. What are the types of premises cases?

There are many types of premises cases.  One type is a slip and fall with an injury from a substance or foreign object on the floor of a building, or ice and snow outside a building. Another premises claim can arrise from negligent security or inadequate lighting in a building whether it be a rental unit, apartment building, dorm, AirBnB, concert, or sporting event. Animal attacks with resulting injuries are another type of store or premises case.  Building code violations resulting in an injury fall into this category.

3. What Should I do after being hurt?

First, seek medical attention.  Next make somone in charge aware that you've been hurt so that someone else doesn't get hurt as well.  Identify witnesses who saw what happened.  Take photos of the area including what you believe to be what caused the injury.  If you've left the scene, after getting medical care, make sure the owner is made aware of the problem.  Then call to speak to a lawyer with years of trial experience in cases like yours.

4. What if I don't want to sue my neighbor? I like my local store. I feel bad suing them. What do I do?

Actually, ninety percent of the time there is insurance that protects the owner of the property where you got hurt.  No one wants to sue a relative or a neighbor, however  that is exactly what insurance is for - to make up for your harms and losses.

5. Why Should I bring a premises case?

When you own property you have responsibilities.  Included in these responsibilities is keeping people safe.  When a store solicits your business, they have a duty to keep you safe. The quid pro quo is an unspoken agreement between consumers and merchants who are profiting from your presence.  As consumers you are spending your time and/or money, and the store is legally obligated to provide a safe environment.

6. When is a grocery store responsible in a slip and fall accident?

Although you visit the store regularly and it has always felt safe, until you slip and fall you may not know about the hidden dangers that await in a supermarket.  Grocery stores have a legal duty to keep their floors and displays safe for customers.

7. Am I going to be blamed for not looking where I was going?

Absolutely.  We've had cases where the team of attorney's and their insurance companies representing the store or premises blame the plaintiff for how they were dressed, wearing shoes without a strong grip, if they were drinking alchohol, medications they were on, and for being distracted.  When a store intentionally attracts your attention with sale signs and eye level displays, most people are not looking at their feet.  Although the defense will certainly blame you, we have years of trial experience and a proven track record in defeating their claims while exposing their motive and hypocracy for blaming the victim. Most clients express feeling betrayed by their favorite stores when they were enticed to shop there and got hurt.

8. How much will it cost to hire your law firm?

It will cost you nothing to hire our law firm. We work on a contingency basis, meaning we are not paid unless and until we successfully recover compensation for you and your family. Because we specialize in serious injury cases, we know what it takes to win.  You pay nothing upfront when you hire our firm, so there is no financial burden on you and your family. It does take a commitment to partner with us so that together we can put forth the best possible case.  We will guide you through the entire process.

Some victims hesitate to call an injury law firm because they fear they cannot afford it. Instead, these people try to take on insurance companies or large trucking corporations on their own. This can make it nearly impossible to spend the time and focus on healing from injuries.
